A&W Secures Summary Judgment

Partner Michelle L. Villarreal and Associate Isaac C. Young secured Summary Judgment in favor of the City of Carson in a dangerous condition of public property lawsuit.

The lawsuit alleged that the lack of a traffic signal constituted a dangerous condition of public property causing a motorist to strike two minor pedestrians crossing the street. The intersection was equipped with flashing beacons, school crossing signs, and pedestrian activated lights on the ground to alert drivers of pedestrians crossing. The City argued there was no dispute of material fact that the City was entitled to traffic safeguard immunity and design immunity where there were no physical defects at the intersection which caused or contributed to the occurrence of the accident. The Court agreed and judgment was entered in favor of the City.
